What Happens at a Bail Hearing in Richmond Hill?

A bail hearing (formally called a “show cause” hearing) determines whether you’ll be released from custody while your case proceeds through the courts. Under sections 515–522 of the Criminal Code of Canada, the Crown must justify why you should remain detained. If they can’tyou’re entitled to release.

Your Right to Bail Hearing Within 24 Hours

Under section 503 of the Criminal Code, you must be brought before a justice within 24 hours of arrest. That’s a guaranteed right — and a very short window to get a lawyer prepared and ready to argue your case.

What the Judge Considers When Setting Bail

When deciding whether to release you and under what conditions, the court weighs three grounds:

  1. Primary Ground—Thecourt first considers whether you are likely to appear for your future court dates. Factors such as your ties to the Richmond Hill community, your employment, and your history of attending court all play a role here.
  2. Secondary Ground —The court looks at whether releasing you could put the public at risk. This includes the nature of the alleged offence, any prior criminal history, and whether there is reason to believe you may reoffend while out on bail.
  3. Tertiary Ground —Evenif the first two grounds are satisfied, a judge may consider whether releasing you would undermine public trust in the justice system. This ground is most commonly applied in cases involving serious or violent offences.

Types of Bail Conditions a Richmond Hill Court May Impose

Ontario courts follow what is known as the ladder principle when it comes to bail. This means the court starts with the least restrictive option and only moves toward stricter conditions if there is a justifiable reason to do so. The default position under Canadian law is release — detention is the exception, not the rule.

Depending on the circumstances of your case, a Richmond Hill court may release you:

  • With no conditions at all (a simple promise to appear)
  • On an undertaking with conditions
  • On a recognizance with or without a surety (a person who agrees to supervise you and be financially responsible if you breach)
  • On a cash deposit in certain situations

Common Bail Conditions

The specific conditions attached to your release will depend on the nature of your charges, but courts in Richmond Hill commonly impose:

  • Reporting conditions — Regular check-ins with a bail supervisor or police.
  • No-contact orders — Prohibiting communication with alleged victims or co-accused.
  • Geographic restrictions — Limiting where you can travel or requiring you to remain in Ontario.
  • Curfews — Requiring you to be at your residence during specific hours.
  • Abstaining from alcohol or drugs — Particularly in cases involving impairment.
  • Weapon prohibitions — Surrendering any firearms or weapons in your possession.
  • Surety supervision — Living with and being monitored by an approved surety.

What Happens If You Breach Your Bail Conditions

Breaching your bail conditions is a serious criminal offence in itself under section 145 of the Criminal Code of Canada. If you are found to have violated any condition of your release, you could face:

  • Immediate arrest and return to custody
  • New criminal charges on top of your existing case
  • A much harder time being granted bail a second time
  • A negative impact on how the court views your overall case

If you are unsure whether an action would put you in breach of your conditions, contact GSP Law before proceeding. It is always better to ask first.

GSP Law

The Bail Hearing

Within 24 hours of your arrest, you will appear before a justice of the peace for your bail hearing. Your lawyer will present arguments for your release, propose conditions if needed, and challenge any Crown arguments for detention.

GSP Law

Release Conditions or Detention Order

If bail is granted, the justice will outline the conditions of your release. These may include reporting requirements, curfews, or no-contact orders. If bail is denied, your lawyer can seek a bail review before a Superior Court judge.

Frequently Asked Questions About Bail Hearings in Richmond Hill

Have questions about the bail process in Richmond Hill? Here are answers to some of the most common ones we hear from clients and their families.

GSP Law is available 24 hours a day, 7 days a week. When you call, we move immediately. Our goal is to have a lawyer prepared and ready before your hearing takes place, regardless of what time of day or night you reach out.

Legal fees vary depending on the complexity of your case. GSP Law offers a free initial consultation, so you can understand your situation and discuss costs before making any decisions. Call us and we will walk you through everything with no obligation.

Yes. If your conditions are too restrictive or your circumstances change, your lawyer can apply to have them varied. GSP Law can guide you through this process and present the strongest case for modification.

A surety is a person — typically a family member or close friend — who agrees to supervise you and take financial responsibility if you breach your bail conditions. Not every case requires a surety, but when one is needed, having the right person prepared and ready to testify can significantly strengthen your case for release.

If bail is denied or the conditions imposed are unreasonable, you have the right to apply for a bail review before a Superior Court judge. At a bail review, new evidence can be introduced and the original decision can be challenged. GSP Law can assess whether a bail review is the right step for your situation.

Yes, bail is possible even on serious charges, though the process is more complex. For certain offences, the burden shifts to you to show why your detention is not justified — this is called a reverse onus situation.

These hearings require careful preparation and experienced legal representation. GSP Law has the knowledge to handle even the most serious and high-stakes bail matters.
