What is Forgery?Β

Forgery is the act of making or altering a document with the intent to deceive others into believing it is genuine, leading to potential harm or loss.Β Β

Under section 366(1) of the Criminal Code of Canada, a person commits forgery when they knowingly create a false document with the intent that it be used or accepted as real, to the prejudice of another person.Β Β

This can include signing someone else’s name, changing important details on a document, or creating entirely fake documents to influence a decision or gain an unfair advantage.Β

More specifically, section 366(2) outlines what counts as making a false document. This includes:Β

  • Altering a real document in a meaningful wayΒ
  • Adding false information like a fake date or sealΒ
  • Changing the document through erasure or other methodsΒ

In addition to creating forged documents, section 368 makes it illegal to knowingly use, sell, or possess these falsified records. Commonly tied to fraud or identity theft, forgery charges carry severe penalties. Early legal intervention is critical.Β

What is Uttering a Forged Document?Β

Uttering a forged document means knowingly presenting or using a document that you believe is fake as if it were real. This can include giving, selling, or even just possessing a forged document with the intention that it be used to commit a crime.Β Β

Unlike just creating a forged document, uttering involves passing it on or using it to deceive others. The law treats uttering a forged document very seriously.Β Β

If charged, penalties can be severeβ€”up to 2 years in prison for a less serious (summary) offence, and up to 10 years for a more serious (indictable) offence. Because the consequences are harsh, it’s important to seek legal help right away if you face such charges.Β

Counterfeiting Under Canadian LawΒ

Counterfeitingβ€”producing or distributing imitation currency, goods, or official marksβ€”is prosecuted under Sections 366–376 of the Criminal Code. Key offences include:Β

  • Currency Counterfeiting: Manufacturing or circulating fake banknotes.Β
  • Counterfeit Marks: Faking government/corporate certifications.Β
  • Tools for Forgery: Possessing devices to create counterfeit items.Β

Penalties escalate based on the offence’s scale, with indictable cases risking up to 14 years’ imprisonment.Β

Types of Forgery-Related Charges in Brampton, OntarioΒ

Forgery-related offences cover a range of crimes involving false documents, tools, and marks used to deceive others. In Brampton, Ontario, these charges carry serious consequences and are governed by specific sections of the Criminal Code of Canada.Β Β

Here are some of the common types of forgery-related charges you may encounter:Β

Trafficking or Possession of a Forged DocumentΒ

Under section 366 of the Criminal Code, it’s illegal to pass off forged documents as genuine for personal gain or to benefit others. Even if someone is unsure about the authenticity of a document but acts recklessly by using or sharing it, they can still be charged.Β Β

This law helps prevent fraud by holding individuals accountable for knowingly or carelessly presenting fake documents as real.Β

Forgery InstrumentsΒ

Section 368.1 prohibits the making, repairing, buying, selling, or owning of any tools or materials that can be used to commit forgery. This includes anything designed to create or alter documents fraudulently. Possessing these instruments with criminal intent can lead to serious charges.Β

Exchequer Bill PaperΒ

Section 369 makes it illegal to possess certain types of special paper, like Exchequer bill paper, which is commonly used to make banknotes.Β Β

This section also bans creating or using official public seals belonging to the government, provinces, courts, or public bodies. Misusing these materials or seals is a criminal offence with strict penalties.Β

Counterfeiting MarkΒ

According to section 376(2), it is unlawful to create, sell, or possess counterfeit marks. These marks are official symbols or insignias that show an item meets specific government or agency standards.Β Β

The law protects these symbols to maintain trust in their authenticity. Using fake marks can lead to serious legal consequences.Β

Penalty For Counterfeiting & Forgery in CanadaΒ

Counterfeiting and forgery are serious criminal offences in Canada, with harsh penalties that can have a lasting impact on your future. Under the Criminal Code of Canada, these crimes involve making or altering documents, money, or goods with the intent to deceive others. This can include:Β

Forging signaturesΒ

Faking government documentsΒ

Creating counterfeit moneyΒ

Producing and selling items with fake brand marksΒ

If you are charged with forgery or counterfeiting, the Crown can proceed by indictment, which is more serious. Under section 367 of the Criminal Code, a forgery conviction can result in up to 10 years in prison.Β Β

In more serious cases (such as those involving counterfeit marks, forgery instruments, or materials used to print money), the penalties can be as high as 14 years.Β

In Ontario and across Canada, these offences are often investigated by federal agencies and require a strong legal defence due to their complexity. A conviction can lead to a permanent criminal record, affect employment and travel, and damage your reputation.Β Β

That’s why you need to consult a forgery criminal defence lawyer right away if you’re facing charges or under investigation for counterfeiting or forgery.Β
