Firearm Offences

R v. C, N (Superior Court of Justice, Brampton)

Charges: Possession for the purpose of Trafficking x4, Trafficking in firearms and Trafficking in ammunition

Result: All charges stayed following a successful Charter application.

R. v. H.Z (Ontario Court of Justice, Barrie)

Charges: Loaded firearm found in centre console of vehicle registered under client’s name, which he was driving on day of incident

Result: Acquitted after 3 day trial. Presiding judge found defence successfully argued that client did not have knowledge of the firearm in his vehicle.

R. v. B.B. (Superior Court of Justice, Brampton)

Charges: Robbery with a firearm x4, Robbery, Firearms related Offences following the execution of a search warrant on the client’s house

Result: Client was discharged at the Preliminary Inquiry for 3 of the 4 Robbery with Firearm charges and the Firearms charges. At trial, client was acquitted of the robbery with the firearm which attracted a 5 year mandatory minimum sentence.

Drug Offences

R v. H, R (Ontario Court of Justice, Barrie)

Charges: Possession of 44 grams of Crack Cocaine, Possession of 1 gram of Heroin, Possession of 44 grams of Cocaine, and Possession for the purpose of Trafficking.

Result: All charges were withdrawn at the request of the Crown on Day 3 of the Preliminary Inquiry after vigorous cross-examination of the police officers involved.

R v. O, D (Ontario Court of Justice, Orangeville)

Charges: Possession of 35 grams of Cocaine and Possession for the purpose of Trafficking.

Result: Client was discharged of all charges at the Preliminary Inquiry after cross examination of the police officers involved negated any link of client to the drugs found.

R v. E, R (Superior Court of Justice, Newmarket)

Charges: Trafficking 350 grams of Cocaine and Possession for the purpose of Trafficking.

Result: All charges were withdrawn at the request of the Crown following a Preliminary Inquiry and committal to the Superior Court of Justice after significant Charter breaches were pointed out following cross examination.

R. v. H.Z (Ontario Court of Justice, Barrie)

Charges: Possession of 302 grams of Crack Cocaine for the Purpose of Trafficking.

Result: Charges withdrawn by the Crown following vigorous cross examination of the police officers at the Preliminary Inquiry in relation to number of serious Charter breaches that was to be the foundation of argument at trial at the Preliminary Inquiry.

Driving Offences

R v. G, A (Ontario Court of Justice, Burlington)

Charges: Impaired Driving and Over 80.

Result: All charges were withdrawn at the request of the Crown on the final day of Trial due to the strength of the Charter application.

Sexual Assault

R v. W, J (Ontario Court of Justice, Brampton)

Charges: Sexual Assault.

Result: Charges were withdrawn at the request of the Crown prior to the commencement of the Preliminary Inquiry.

Domestic Assault

R. v. S., G. (Ontario Court of Justice, Brampton)

Charges: Charges: Assault x4

Result: All charges withdrawn at the request of the Crown on the first day of trial after providing significant documentation.

Robbery

R. v. M, M. (Ontario Court of Justice, Brampton)

Charges: Robbery

Result: All charges withdrawn following successful discussions with Crown on the first day of trial.

Serious Personal Injury

R v. M, M. (Ontario Court of Justice, Brampton)

Charges: Assault Bodily Harm

Result: All charges withdrawn following successful discussions with the Crown.
