What is the Sentence for Attempted Murder?

Attempted murder is a very serious offence in Canada and comes with some of the harshest penalties under the law. If convicted, the maximum sentence is life in prison.

In cases where a firearm is used (especially if it’s a restricted or prohibited weapon linked to organized crime), the law requires a minimum sentence of 5 years.

Even if it’s not tied to organized crime, using any type of firearm in the offence brings a minimum sentence of 4 years. If someone receives a life sentence, they can apply for parole after serving at least 7 years.

However, parole is not guaranteed and depends on many factors, including the nature of the offence and the person’s behavior in prison.

Defence Strategy for Attempted Murder Charges in Toronto and the GTA

We know how serious and complex attempted murder charges can be. That’s why we take a careful, strategic approach to every case. If you’ve been charged in Toronto, Brampton, or anywhere in the GTA, we’re here to guide you through every step of the legal process.

Arrest and Bail for Attempted Murder

When you’re arrested for attempted murder, the police must inform you of your Charter rights, including the right to remain silent and the right to a lawyer. It’s best to use those rights and avoid speaking to police until you’ve contacted an experienced attempted murder lawyer.

Because of the seriousness of the charge, you’ll likely be held in custody until a bail hearing, which usually happens within 24 hours. Bail in these cases can be difficult, but everyone has the right to a fair bail hearing.

Our team will work quickly to present a strong case for your release, addressing the Crown’s concerns and proposing conditions that meet the court’s requirements. This might include supervision by surety, house arrest, or other restrictions.

Getting legal help early can improve your chances of getting bail under more manageable conditions.

Pre-trial Appearances in Attempted Murder Cases

Once bail is decided, your lawyer will start preparing your defence. This begins with obtaining full disclosure from the Crown, something only a lawyer can fully access.

After reviewing the evidence, we’ll attend Crown pre-trial (CPT) and judicial pre-trial (JPT) meetings to negotiate and build your case. You won’t need to attend these meetings yourself if you have legal representation.

You’ll also need to choose how your trial will proceed, whether by judge or jury, and in provincial or superior court. You may be entitled to a preliminary inquiry, where we can challenge the strength of the evidence.

With GSP Law by your side, you’ll get the guidance you need to make informed decisions that give you the best chance of success.

Consequences of Conviction for Attempted Murder

A conviction for attempted murder can mean a life sentence. If a firearm was used, the law imposes mandatory minimum sentences – 4 years for a regular firearm, 5 years for a restricted or prohibited firearm, and 7 years for repeat offences.

Beyond prison time, a conviction also comes with serious long-term consequences. These include a weapons ban and a DNA order, which requires your DNA to be stored in the National DNA Data Bank.

While it’s possible to challenge a DNA order, courts are unlikely to remove it for such a serious offence. That’s why a strong, experienced legal defence is essential from the very beginning

Understanding How the Criminal Defence System Works

Facing criminal charges can feel overwhelming but knowing how the defence process works can make it easier to navigate. Whether you’re dealing with serious charges like attempted murder or another criminal offence, early legal support can improve your chances of a better outcome.

Here’s a simple breakdown of what to expect and how GSP Law supports you at each stage:

Retainer

The first step is hiring a criminal defence lawyer. When you retain GSP Law, we will begin reviewing your case right away. We’ll explain your legal rights, outline your options, and start building a personalized defence plan.

We also offer flexible payment options, including private retainer and legal aid services, to make strong representation more accessible.

Initial Consultation

Your initial consultation gives you a chance to discuss your case confidentially. We’ll listen to your side of the story, answer your questions, and help you understand the legal process ahead. This is also when we start identifying key issues in your case and determine the best strategy moving forward.

Arrest & Bail Hearing

If you’ve been arrested, you’ll be brought before a judge for a bail hearing, usually within 24 hours. The court will decide whether you’ll be held in custody or released while awaiting trial.

Our team will argue for your release under fair conditions, addressing any concerns the Crown may raise, and advocating for your freedom during the legal process.

First Court Appearance

Your first appearance in court is when the charges against you are formally read. Your lawyer will attend with you (or on your behalf in some cases), protect your legal rights, and ensure that proper procedures are followed. This stage sets the groundwork for everything that follows.

Evidence Disclosure

The Crown is required to provide all relevant evidence, including police reports, surveillance, and witness statements. A strong defence depends on a thorough review of this material—your lawyer will look for inconsistencies, rights violations, and any gaps that could work in your favor.

Negotiation and Resolution

Many break and enter-related cases are resolved without trial. Your lawyer may negotiate to have the charges reduced or withdrawn or push for alternative resolutions where appropriate. If your case proceeds to trial, your lawyer will defend you vigorously to pursue the best possible result.

Frequently Asked Questions (FAQs) About Attempted Murder

The sentence for attempted murder in Toronto (and across Canada) depends on the specific details of the case. The minimum penalty ranges from 4 to 7 years in prison, especially when a firearm is involved or if it’s a repeat offence. The maximum sentence is life imprisonment, as outlined under Section 239(1) of the Criminal Code.

In Canadian law, attempted murder refers to trying to kill someone, even if the person survives. The Criminal Code does not recognize the term "frustrated murder" as a legal category.

However, the phrase is sometimes used informally to describe situations where a person survives an attempt on their life—often due to medical help or other outside factors.

The maximum sentence for attempted murder in Ontario is life in prison. The mandatory minimum sentence can range from 4 to 7 years, depending on the circumstances—such as whether a firearm was used, and if the offence is a first or repeat conviction.

Under Section 239 of the Criminal Code of Canada, attempted murder is defined as when someone intentionally tries to cause the death of another person, regardless of whether the attempt is successful. The attempt may involve a firearm, a weapon, or any other method intended to kill.
