What is Forgery? 

Forgery is the act of making or altering a document with the intent to deceive others into believing it is genuine, leading to potential harm or loss.  

Under section 366(1) of the Criminal Code of Canada, a person commits forgery when they knowingly create a false document with the intent that it be used or accepted as real, to the prejudice of another person.  

This can include signing someone else’s name, changing important details on a document, or creating entirely fake documents to influence a decision or gain an unfair advantage. 

More specifically, section 366(2) outlines what counts as making a false document. This includes: 

  • Altering a real document in a meaningful way 
  • Adding false information like a fake date or seal 
  • Changing the document through erasure or other methods 

In addition to creating forged documents, section 368 makes it illegal to knowingly use, sell, or possess these falsified records. Commonly tied to fraud or identity theft, forgery charges carry severe penalties. Early legal intervention is critical. 

What is Uttering a Forged Document? 

Uttering a forged document means knowingly presenting or using a document that you believe is fake as if it were real. This can include giving, selling, or even just possessing a forged document with the intention that it be used to commit a crime.  

Unlike just creating a forged document, uttering involves passing it on or using it to deceive others. The law treats uttering a forged document very seriously.  

If charged, penalties can be severe—up to 2 years in prison for a less serious (summary) offence, and up to 10 years for a more serious (indictable) offence. Because the consequences are harsh, it’s important to seek legal help right away if you face such charges. 

Counterfeiting Under Canadian Law 

Counterfeiting—producing or distributing imitation currency, goods, or official marks—is prosecuted under Sections 366–376 of the Criminal Code. Key offences include: 

  • Currency Counterfeiting: Manufacturing or circulating fake banknotes. 
  • Counterfeit Marks: Faking government/corporate certifications. 
  • Tools for Forgery: Possessing devices to create counterfeit items. 

Penalties escalate based on the offence’s scale, with indictable cases risking up to 14 years’ imprisonment. 

Types of Forgery-Related Charges in Brampton, Ontario

Counterfeiting Mark 

According to section 376(2), it is unlawful to create, sell, or possess counterfeit marks. These marks are official symbols or insignias that show an item meets specific government or agency standards.  

The law protects these symbols to maintain trust in their authenticity. Using fake marks can lead to serious legal consequences.
